We received a $366,000 TP recovery claim on this earthmoving equipment which had reportedly suffered a lightning strike event. We were instructed by a legal firm to provide an expert report on the incident, damage and confirmed costs.
A comprehensive inspection with an ARC Assessing Equipment Specialist
After completing our due diligence, we clearly showed there was no evidence to prove the event as described had happened. We presented a list of 12 questions for clarification to the TP insurer and their appointed assessing provider.
When the TP insurer and assessing provider failed to answer any questions after a 3-month period and following instruction from the legal team, we adjusted the presented costs to a fair and reasonable settlement recommendation of $125,000 net of GST.
As this claim came to us as a TP recovery claim with minimal information, the challenge was to identify all relevant missing information, discuss all aspects of it with the legal team in a way they understand and then provide a fair and reasonable report that clearly illustrates that all variables have been considered.
We provided recommendations around 3 different areas of the repair:
1. Components likely to be damaged
2. Components possibly damaged
3. Components not likely damaged as a result of the described event.
On a fair and reasonable basis we provided a recommendation based on paying for all components likely damaged and all components possibly damaged and presented a claim settlement recommendation in the amount of $125,000 net GST. We believe our recommendation has been accepted by all parties.
